IN THE SUPREME COURT OF INDIA CRIMINAL APPELLATE JURISDICTION CRIMINAL APPEAL NO. 266 OF 2004 VIJAY KUMAR BAJAJ .. APPELLANT(S) vs.
STATE OF PUNJAB & ANR .. RESPONDENT(S) O R D E R We have perused the counter affidavit filed by the State of Punjab and para 6 of the preliminary objections where we find that there is a reference to the fact that the cancellation Report filed in Court had been accepted by the Court on 31st May, 2003. Mr. K.G. Bhagat, the learned counsel appearing for the complainant states that he had filed a protest petition against the cancellation report and the Court was presently seized of that matter. We, accordingly, clarify that if an order adverse to the appellant is made by the Criminal Court, it would be open to him to challenge those proceedings in an appropriate forum. As far as this matter is concerned, it is disposed of as having become infructuous.
