After hearing the learned counsels for both the parties at some length and also considering the question raised in the Writ Petition, we deem it just and proper to refer the question as to the constitutionality of the Sections 9(a) of COFEPOSA and 10(1) of the Prevention of Illicit Traffic in Narcotic Drugs & Psychotropic Substances Act, 1988 to the learned Chief Justice to constitute a bench for hearing this constitutional question. The application for grant of parole or interim bail is, however, rejected. The petitioner may, however, approach the Constitution Bench for appropriate order.
