JUDGMENT / ORDER

1. Heard the learned counsel for the parties.
2. It is an admitted fact that on the same evidence the other accused (except the present respondents) were tried and acquitted in TADA case No. 1/1995 by the session judge & designated judge, Valsad at Navsari vide order dated 16.6.1997. Criminal appeal No. 945/1997 filed by the state against the said acquittal, order was dismissed by this Court vide order dated 28.4.1998. Thereafter, the present respondents were apprehended and tried for the same offence. The evidence which was relied, in previous case was relied upon by the prosecution for connecting the accused with the crime. After trial, the designated judge, Valsad at Navsari in TADA case No. 3/96 with special TADA case No. 1/98 acquitted the respondents by judgment and order dated 8.10.1999. Against that judgment and order, these appeals have been filed.
3. In view of these facts, these appeals are also dismissed.
