We have heard the learned counsel for the parties at length.
In the facts and circumstances of this case, we deem it appropriate to implead H.S.B.C. Bank Middle East Limited as a defendant in Civil Suit No.13A of 2009 which is pending before the Court of District Judge, Indore. The H.S.B.C. Bank would be at liberty to file written statement within six weeks from the date of joining as a party.
In the facts and circumstances of this case, hearing of the suit is expedited.

Mr. Rawal, learned senior counsel appearing on behalf of the respondent Indian Steel Corporation Ltd. submits that he has to make some amendment in the suit. If a proper application for that purpose is filed, suitable/appropriate orders may be passed thereon in accordance with law.
This appeal is disposed of with the aforementioned observation and direction, leaving the parties to bear their own costs.
