LTD. ...Appellant (s) VERSUS M/S GOLDEN CHARIOT AIRPORT AND ANOTHER ...Respondent(s) WITH Civil Appeal NO. 8200 of 2010 (arising out of SLP(C)No.11663/2009) O R D E R Judgment in these appeals was pronounced on 22nd September, 2010.
Today, Shri Shyam Divan, learned senior counsel who appeared for respondent no.1 - M/s. Golden Chariot Airport, made a request that his client may be allowed two months' time to vacate the site and hand over possession thereof to the Mumbai International Airport Pvt. Ltd.
We have heard learned counsel for the parties on the prayer of Shri Divan and are of the view that it will in the interest of justice if time is allowed to respondent no.1 - M/s. Golden Chariot Airport till 31st October, 2010 to vacate the site and hand over possession to the concerned authority of Mumbai International Airport Pvt. Ltd. Ordered accordingly. This will be subject to the filing of an undertaking by respondent no.1 in this Court within a period of seven days from today.
Shri C.A. Sundaram, learned counsel appearing for Mumbai International Airport Pvt. Ltd. says that engineers of his client may be permitted to inspect the site where respondent no.1 is running the restaurant. Shri Shyam Divan says that his client will have no objection to this.
