RESPONDENTS O R D E R Learned counsel for the parties point out that in the light of the fact that the civil suit inter se the parties have been withdrawn on the 8th of August, 2005, on account of a settlement arrived at between them, the present civil appeal which arises out of an interim order has become infructuous.
The appeal is, accordingly, dismissed as such.
