Learned counsel for the parties have filed a Memorandum of Settlement stating therein that the dispute between the parties has been settled. The appeal is accordingly disposed of in terms of the Memorandum of Settlement.
Learned counsel appearing on behalf of the appellants submits that the balance amount of Rs.4,00,000/- (rupees four lakh) is still due. A cheque has already been issued which has now been handed over to Mr.S.N.Bhat, learned counsel appearing on behalf of respondent No.4 and the same has been accepted by Mr.Bhat. Learned counsel for the appellants also wants to file an affidavit in this regard. He may do so.
