1. Mr. Rajinder Sachhar, learned Senior counsel has placed on record a certificate signed by Dr. J.M. Dua of Indraprastha Apollo Hospital dated 28.1.99.
2. The learned Additional Solicitor General, who appears on behalf of the C.B.I. has produced the record of the case before us. From a cursory look of the record, it appears that the averments made in the application seeking bail (I.A. No. 15 of 1999) filed on behalf of Mr. V.K. Tiwari are not correct. Before we decide to proceed further we direct that the C.B.I. shall state on an affidavit of the Investigating Officer about the circumstances under which Mr. V.K. Tiwari was taken into custody and his subsequent admission in the hospital/hospitals under judicial orders. An up-to-date report regarding custody of Mr. V.K. Tiwari shall be submitted along with the affidavit, by the C.B.I.
3. The C.B.I. shall also indicate the manner in which the identity of Mr. V.K. Tiwari has been established. This has become necessary because of the admission of a patient by the name of Mr. Purshottam Sen in Jaslok Hospital and Research center, Mumbai and the claim that he is none other than V.K. Tiwari himself. Let the needful be done within five days.
