JUDGMENT / ORDER

1. The appellant has filed an application for permission to withdraw these appeals filed under Section 130E of the Customs Act. The same request has been reiterated before us by the learned Counsel for the appellant. It is stated by the learned Counsel for the appellant that the appellant is desirous of approaching the authorities concerned for settlement of the case under the provisions of the Kar Vivad Samadhan Scheme, 1998 and that the amount has already been paid in accordance with the declaration filed by the appellant/assessee. It is also brought to our notice that by a communication dated 18-3-99, the designated authority required the appellant to furnish documentary proof of withdrawal of the pending appeal/writ petition. In view of this representation, the appeals are dismissed as withdrawn without prejudice to the appellant's remedy to approach the Authority under the provisions of the said scheme for appropriate relief.
2. There shall be no order as to costs.
