JUDGMENT / ORDER

IN THE SUPREME COURT OF INDIA CIVIL APPELLATE JURISDICTION CIVIL APPEAL NO.3998 OF 2007 EXECUTIVE ENGINEER, SIDHMUKH APPELLANT VERSUS MOHINDER SINGH RESPONDENT O R D E R Having heard learned counsel for the parties and after going through the impugned orders and considering the fact that in compliance with the impugned order of the High Court the respondent-workman has already been reinstated in the service, we are not inclined to interfere with the order of reinstatement passed by the Labour Court and affirmed by the High Court. However, considering the facts and circumstances of the present case, we direct that the respondent be paid the entire back wages to the extent of 25 per cent instead of 50%. With this modification, the appeal is disposed of with no order as to costs. Interim order, if any, shall stand vacated.
