Heard learned counsel for the parties.
During the pendency of these matters, the parties have amicably settled the matters. Learned counsel appearing for the workmen submits that all the remaining 50 petitioners-workmen will accept the same terms and conditions which were extended to other workmen by the management. The amount is already deposited with the Labour Commissioner, Mumbai – respondent no.3 herein. Mr.N.M.Ganguly, learned counsel for the workmen, who is present in Court, undertakes to identify these workmen and on identification from him, the amount would be released to these workmen.
Learned counsel submitted that during the pendency of these matters, three workmen, namely Mr.Ebrahim Dawood Gadkari, petitioner no.16 herein, Mr.Dilip Tukaram Kambli-petitioner no.32 herein and Mr.Ramjit Ramshiroman Mishra-petitioner no.40 herein, have expired. Their legal representatives may file indemnity bonds with affidavits before the Labour Commissioner, Mumbai and on : 2 :
receiving the same, the amount would be released to the legal heirs of these three workmen. A copy of the same be given to learned counsel for respondent no.1. No further directions are necessary in these appeals. These appeals are, accordingly, disposed of, leaving the parties to bear their own costs.
