JUDGMENT / ORDER

IN THE SUPREME COURT OF INDIA CRIMINAL APPELLATE JURISDICTION CRIMINAL APPEAL NO.1764 OF 2010 (Arising out of SLP(Crl.)No.3493 of 2010) BAPU LAGAMANNA NAIK & ANR. APPELLANT(S) VERSUS STATE OF KARNATAKA RESPONDENT(S) O R D E R Leave granted.
2. We have heard learned counsel for the parties.
3. The appellants have been awarded sentence of three months rigorous imprisonment under Sections 419,468,471 r/w 34 of I.P.C. and appellants submit that they have already undergone 56 days of actual imprisonment. This fact is not controverted by learned counsel for the State of Karnataka. In this view of the matter, while maintaining the conviction, we deem it appropriate to release the appellants on the sentence already undergone.
The appeal is disposed of accordingly.
