Ms. Mishra, learned counsel for the respondent- wife states that she has instructions not to contest the appeal. In this view of the matter, the award of the Lok Adalat dissolving the marriage by mutual consent under Section 13B of the Hindu Marriage Act is maintained.
Learned counsel further states that certain certificates of Class X and Class XII belonging to the respondent-wife as also her sthridhan with the appellant herein and that the same should be returned to her.
Though this is not a matter of dispute in the present proceedings, we nevertheless feel that as the matter is being disposed of in the manner indicated above, if any such documents or sthridhan are lying with the appellant-husband, he should handover the same to the respondent-wife forthwith.
The appeal is allowed in the aforesaid terms.
