Agra Development Authority vs M/S. Goyal Investments and Ors

Supreme Court Of India|03 March, 2006

JUDGMENT / ORDER

Despite service of notice, there is no one present on behalf of the added respondent No.2, Supriya Chopra.
This Special Leave Petition is directed against an order passed by the Punjab & Haryana High Court allowing the petitioner's prayer for interim anticipatory bail subject to the petitioner paying a sum of Rs. 1 lakh to the complainant within a period of 15 days from the date of the order in the presence of the Investigating Officer. It now transpires from -2- certain submission made on behalf of the petitioner, which is also supported by certain orders, that the First Information Report, being No. 359 dated 12th August, 2006, of P.S. Central Faridabad, Distt. Faridabad, has been quashed by the High Court on the basis of compromise effected between the parties. The terms of compromise have been set out in the order of the Punjab & Haryana High Court dated 8th May, 2007.
Pursuant to the said order consequential steps have also been taken in the Matrimonial Suit which has ultimately ended in mutual divorce under Section 13-B of the Hindu Marriage Act, 1955.
As far as the compromise is concerned, the same appears to have been worked out. In view of the quashing of the FIR, nothing further remains as far as this Special Leave Petition is concerned, however, while issuing notice on 18th September, 2006, this Court had directed the petitioner to deposit a sum of Rs. 1 lakh with the Registrar General of the Punjab & Haryana High Court within two weeks from the date of the said order. It is submitted that the same was duly deposited by the petitioner. Inasmuch as the said amount directed to be deposited by this Court has no connection with the terms of settlement arrived at between the parties, we direct that the said amount deposited with the Punjab & Haryana High Court to be made over to the petitioner on receipt of a copy of this order.
The Special Leave Petition is disposed of accordingly.
